Stored Credentials Statement
STORED CREDENTIALS CONSENT AGREEMENT
1. General Terms
1.1 This Agreement is between CalMac Ferries Limited (Company number SC302282) with registered office address at The Ferry Terminal, Gourock, PA19 1QP, United Kingdom ("CalMac") and you, the cardholder, (hereinafter, "Cardholder", "you" or "your").
1.2 Stored payment information (in the context of this Agreement, a series of randomly generated numbers (a "Token") enabling card transactions to be processed securely without sensitive card details being held on your CalMac customer account (the "Customer Account")) are used to process future purchases (the "Stored Credentials").
1.3 By completing the process described in paragraph 7 below and so accepting the terms set out in this document (the "Terms"), you authorise CalMac to store the Stored Credentials in compliance with the payment card network operating rules for the Visa, Mastercard, American Express and WorldPay networks (collectively the "Card Scheme Rules").
1.4 You hereby authorise CalMac and any third party payment processors providing services to CalMac to store the information pertaining to your Token and/or Stored Credentials for any future purchases or transactions you choose to make or carry out on the Website or by telephone.
2. Use of the Stored Credentials
2.1 Once registered on your Customer Account, the Stored Credentials will be used to process payment or refunds relating to:
2.1.1 new travel bookings (each a "Booking") and amendments to Bookings ("Booking Amendments") made on https://www.calmac.co.uk/ (the "Website"); and
2.1.2 new Bookings and Booking Amendments made by you via telephone when you quote your Customer Account.
2.2 The use of other information that may be contained within the Stored Credentials, such as your name and email address, will only be used in accordance with CalMac's Privacy Policy available at https://www.calmac.co.uk/privacy-and-cookie-policy
2.3 If the Stored Credentials have previously been used to pay for a Booking and/or Amendment which remains in the CalMac Booking system (a "Booking Specific Transaction"), the Stored Credentials will continue to be offered as a payment type for any given Booking Specific Transaction when making a Booking Amendment, even where a Consent Withdrawal has been provided in accordance with paragraph 5.1 below. However you will always have the option to accept or decline the Stored Credentials offered by the CalMac Booking system.
3. Tokens will only be used to process payments and refunds relating to ferry Bookings made with CalMac Ferries Limited.
3.1 The Token associated with the Booking will expire, along with the Booking, on the earlier of: (i) the passing of the date of travel relating to the relevant Booking; or (ii) the date of cancellation of the relevant Booking.
4. Variation
4.1 CalMac will communicate any changes made to these Terms (and so to your Agreement) within seven (7) working days using all of the following methods of communication:
4.1.1 email sent to the email address registered in your CalMac Customer Account;
4.1.2 notification on the Website; and
4.1.3 notification in My Account online.
5. Term and Termination
5.1 You can withdraw consent in respect of non-Booking Specific Transactions at any time by accessing your Customer Account online and deleting any relevant Stored Credentials ("Consent Withdrawal"). Consent Withdrawal is effective immediately once the deletion is made.
5.2 This Agreement is valid until the earlier of: (i) the expiry date of the stored payment card; or (ii) the date of Consent Withdrawal.
6. During the payment flow process, if you select 'Agree & Continue', you will be confirming your acceptance of these Terms and so creating your Agreement with CalMac. You should print out a copy of these Terms for future reference.
7. If you misplace your copy of these Terms, please select the 'resend Saved Card Agreement' option in your Customer Account to arrange for a copy of your Agreement to be sent to the email address registered in your Customer Account.
